1. Acceptance
These terms and conditions govern all services provided by Infinity Media
Design to the Client, encompassing website development, design, hosting, and any related solutions.
Acceptance of a quote signifies the Client’s acknowledgment that they have thoroughly reviewed and fully accepted these terms and conditions. Please read them carefully, as any purchase or use of our services constitutes full
acceptance of these terms.
Definitions
Hosting
Hosting refers solely to the provision of server infrastructure, storage, backups, and basic website availability. Hosting does not include responsibility for the internal build structure, framework stability, compatibility, or functionality of the website, which are governed separately under Website Framework Responsibility.
Website Framework
The Website Framework refers to the underlying technical structure on which a website is built, including the core platform and essential structural components required for the website to function as designed.
Framework Responsibility
Framework Responsibility is separate from Hosting and relates specifically to the technical structure of the website rather than the server environment on which it is hosted.
2. Charges
Charges for services are outlined in the project quotation provided via email and are valid for 7 days. After this period, Infinity Media Design reserves the right to amend or withdraw the offer.
Charges may be based on a fixed project fee or an hourly rate, as specified in the project quotation. Unless otherwise agreed in writing, all design services require a non-refundable advance payment of fifty (50) percent of the total project quotation before work begins. The remaining balance is due upon project completion, prior to the release of any final materials or upload to the server.
Advance payments are strictly non-refundable once work has commenced, except as required by law.
The Client agrees to reimburse Infinity Media Design for additional project-related expenses, such as domain names, special fonts, and stock photography. These costs will be itemised and added to the final invoice unless otherwise agreed in writing.
3. Invoicing and Payment
Invoices for recurring services, including hosting, social media management, website framework responsibility, and other ongoing services, are issued on the 20th of each month for that service month (for example, an invoice issued on 20 February covers services provided in February).
Payment is due by the last day of the invoiced month, unless otherwise stated in writing.
Where payment is not received within 7 days of the invoice due date, Infinity Media Design reserves the right to apply a flat late payment administration fee of £25 per overdue invoice.
Where an invoice remains unpaid for more than 14 days, Infinity Media Design may suspend services until the outstanding balance has been paid in full.
Late payment fees are intended solely to cover administrative and recovery costs and do not constitute a penalty.
If payment remains outstanding for 30 days or more, Infinity Media Design reserves the right to terminate services. Any outstanding balance remains payable in full, and Infinity Media Design reserves the right to take further action to recover overdue amounts. To avoid disruption, clients are strongly encouraged to set up Standing Orders or Direct Debits by the 25th or 26th of the month to allow sufficient processing time and prevent automatic suspension or late fees.
Clients remain responsible for ensuring that standing orders, direct debits, or card payments reflect the correct amounts and are processed on time. Any underpayments, failed transactions, or rejected payments will be treated as overdue, and services may remain suspended until the full outstanding balance is received.
All card payments are processed securely via trusted third-party providers such as Stripe and GoCardless. Infinity Media Design does not store or have access to clients’ full payment card details. Clients are responsible for ensuring their payment information is accurate and kept up to date when using these services.

3.1 Subscription Services
Certain services may be offered on a subscription basis and billed on a recurring cycle. Subscription details, including billing frequency, pricing, and cancellation terms, will be specified at the time the subscription is created or confirmed.
Subscription services continue on a recurring basis until cancelled in accordance with the applicable notice period or cancellation method stated at the time of subscription.
Subscription cancellations apply prospectively only and do not entitle the Client to refunds for services already delivered or billing periods already commenced.
Subscription services are subject to these Terms & Conditions unless otherwise agreed in writing.
4. Project Timelines and Client Delays
Infinity Media Design is committed to meeting the project timelines agreed with the Client but cannot be held liable for delays in project completion due to unforeseen circumstances beyond our control. Any anticipated delays will be promptly communicated to the Client in writing.
To support efficient project delivery, the Client must provide all necessary content (e.g., text, images) within one week of the advance payment. If required materials are not provided within this timeframe, Infinity Media Design reserves the right to adjust project deadlines and, if necessary, apply revised project costs to accommodate delays, or, at our discretion, to terminate the project.
Infinity Media Design reserves the right to track and invoice for any additional time spent on project adjustments or delays beyond the agreed scope, including those directly caused by the Client. Additional work will be invoiced at our prevailing hourly rate.
5. Client Review
The Client will have the opportunity to review and provide feedback on all work supplied by Infinity Media Design, whether as part of a project or as individual tasks, updates, or deliverables. If no feedback or requests for revisions are submitted within seven (7) working days of delivery or go-live, the materials will be deemed accepted by the Client. The Client is encouraged to provide timely feedback within the review period to avoid any delays.
Any changes requested after the final sign-off or the expiry of the review period will be considered new work and quoted separately at our standard rate.
6. Client Responsibilities and Scope of Work
To support timely project delivery, the Client must provide all requested information, materials, and approvals within the specified timeframes agreed upon at the project outset. Failure to provide essential items or respond within fifteen (15) working days may constitute a material breach of the service agreement, at the sole discretion of Infinity Media Design. In such cases, Infinity Media Design reserves the right to suspend or terminate the service and recover incurred project costs, expenses, and other reasonable fees.
Requests for changes or additions beyond the agreed project scope will incur additional charges at our prevailing hourly rate. Infinity Media Design reserves the right to request payment in advance for additional work, with further revisions commencing only upon receipt of payment.
For social media services, clients must provide content approvals and feedback by the 20th of the month for that service month. If no approval is received by this date, Infinity Media Design will proceed with the scheduled content plan.
Any late change requests after the 20th may be subject to:
• Additional charges, depending on the extent of the changes.
• Scheduling constraints, meaning changes may not be accommodated immediately or at all.
Client Responsibility for Payments
Clients are expected to make all payments on time and in full each month to avoid disruption to their services. Infinity Media Design cannot be held responsible for any inconvenience caused by service suspension due to late or missed payments.
It is the client’s responsibility to ensure that payment details, including standing order amounts, are correct and processed on time. Any incorrect payments that result in underpayment will still be treated as late, and services will not be reinstated until the full outstanding balance is received.
Infinity Media Design will ensure that all work is carried out as specified in accordance with the initial terms agreed with the Client. Transparent communication will be maintained if adjustments to timelines or costs become necessary.
Client Responsibility for Accuracy and Review
The Client is responsible for ensuring that all information, content, and materials provided to Infinity Media Design are accurate, complete, and up to date. This includes verifying details before submission and reviewing any updates, changes, or content once implemented.
The Client must review all completed work within seven (7) working days of delivery or go-live and raise any errors or issues within this period. If no feedback or revision requests are received within this time, the work will be deemed accepted by the Client. Infinity Media Design is not liable for errors, omissions, or issues raised after this review period, and any changes requested will be considered new work and quoted separately at our standard rate.
The Client is responsible for ensuring all work requests, approvals, and feedback are submitted via approved communication channels. Any delays or errors resulting from instructions sent outside these channels are solely the Client’s responsibility.
6.1 Service Communication and Updates
Infinity Media Design provides important service-related updates via email to keep clients informed of relevant changes, system improvements, new features, or other essential information relating to their services. These communications are delivered in a clear and accessible format using email distribution tools.
By engaging with Infinity Media Design, the Client agrees to receive such service communications. All emails will include an option to unsubscribe. However, unsubscribing may result in missing critical updates, which will not be communicated via alternative methods.
In addition to essential service-related updates, we may send occasional marketing communications to clients who have given explicit consent (such as newsletters or promotions). You may withdraw this consent at any time by clicking the unsubscribe link or contacting us directly.
6.2 Project Pause Due to Client Inactivity
If a Client fails to provide essential content, materials, or communication for more than fifteen (15) working days, Infinity Media Design reserves the right to pause the project.
A reactivation fee may be charged, and the timeline will be rescheduled according to current availability. If the project remains paused for sixty (60) days or more, Infinity Media Design may consider the project abandoned and issue a final invoice for work completed to date.
Any further work will require a new quotation and agreement.
6.3 Communication Protocol
All project-related communication including work requests, approvals, feedback, change instructions, and general correspondence must be conducted via email, any designated project management tool, the official request forms provided, or other official channels expressly approved and provided by Infinity Media Design. This may include, where applicable, secure live chat via the client portal or website.
Any communication sent via other channels including, but not limited to, text messages, instant messaging platforms, social media, or verbal conversations will be considered informal, non-binding, and will not be actioned unless subsequently confirmed through an approved channel.
Failure to use approved communication channels may result in delays, for which Infinity Media Design accepts no liability.
6.4 Communication Timeframes
We aim to acknowledge and respond to general communication including non-urgent work requests, feedback, or queries within 1–2 working days, subject to workload and availability. In peak periods, this may extend to a maximum of 5 working days.
Urgent matters affecting service availability will be prioritised. Different timeframes may apply for clients subscribed to an Infinity Media Design Care Plan or other enhanced service package.
7. Web Browsers and Devices
Infinity Media Design designs websites to be compatible with widely-used browsers and devices, including the latest versions of Chrome, Safari, Firefox, and Edge.
However, we cannot guarantee full functionality across all browsers and devices, especially as new versions and platforms are released. Should specific adjustments be required for compatibility with additional browsers or devices, a separate quote for these services can be provided.
8. Termination of Service by Client
Cancellation requests must be submitted in writing via email, with a one-month notice period.
If Infinity Media Design terminates services due to a breach of agreement by the Client, we reserve the right to terminate services immediately without liability for any resulting disruptions. In such cases, Infinity Media Design also reserves the right to remove services, revoke access to content, and pursue legal action for contractual breaches.
For recurring services, including social media management:
• If termination occurs mid-month, all pre-approved or scheduled content for that month will still be posted, unless an early cancellation fee is paid to halt publication.
• No refunds will be issued for services already rendered or scheduled.
• Clients remain responsible for any outstanding payments due at the time of termination.
For overdue invoices, see Section 3 (Invoicing and Payment) for termination policies related to late payments.
8.1 Termination by Infinity Media Design
Infinity Media Design reserves the right to terminate any service or working relationship at its sole discretion, with or without cause, by providing one-month written notice, in line with our standard cancellation terms.
Valid reasons may include (but are not limited to):
• Unreasonable client behaviour or demands.
• Repeated failure to meet responsibilities or deadlines.
• Excessive or inappropriate communication.
• Misalignment of values, expectations, or working practices.
For overdue invoices, see Section 3 (Invoicing and Payment) for termination policies related to late payments.
Work completed up to the point of termination will be invoiced accordingly. Any files, materials, or access will only be released upon settlement of all outstanding invoices. Infinity Media Design is under no obligation to provide future services to the Client once notice has been issued.
Infinity Media Design is not required to provide a detailed justification for discretionary termination.
8.2 Post-Termination Assistance
Following termination of services, Infinity Media Design is under no obligation to provide any further support, handover, or transition assistance. Any such services will be considered billable work and provided entirely at our discretion.
Where post-termination assistance is agreed, all work must be paid for in advance based on a written quotation. This may include, but is not limited to, supplying final files, transferring accounts or hosting, liaising with third parties, or providing technical guidance.
All outstanding balances must be settled before any post-termination work commences. Time will be charged at our prevailing hourly rate, with a minimum one-hour charge applying.
9. Indemnity
The Client agrees to indemnify and hold Infinity Media Design harmless from any damages, losses, or expenses resulting from the Client’s use of our services.
10. Copyright and Content Usage
The Client retains full copyright ownership of all content, materials, and intellectual property provided for the project and grants Infinity Media Design a non-exclusive, royalty-free licence to use these materials solely for the purpose of completing the project.
The Client is solely responsible for ensuring all necessary permissions and licences for any third-party content provided, confirming that it is free from copyright restrictions or claims.
Infinity Media Design assumes no liability for any copyright infringements or legal issues resulting from Client-supplied materials, including third-party claims.
Additionally, the Client is responsible for ensuring all files, plugins, scripts, and other materials provided are free from malicious code, viruses, or technical conflicts. Infinity Media Design will not be held liable for issues caused by corrupted, outdated, or insecure client-supplied materials.
10.1 Intellectual Property
The Client retains full copyright ownership of all content, materials, and intellectual property provided for the project and grants Infinity Media Design a non-exclusive, royalty-free licence to use these materials solely for the purpose of completing the project.
The Client is solely responsible for ensuring all necessary permissions and licences for any third-party content provided, confirming that it is free from copyright restrictions or claims.
Infinity Media Design assumes no liability for any copyright infringements or legal issues resulting from Client-supplied materials, including third-party claims.
Additionally, the Client is responsible for ensuring all files, plugins, scripts, and other materials provided are free from malicious code, viruses, or technical conflicts. Infinity Media Design will not be held liable for issues caused by corrupted, outdated, or insecure client-supplied materials.
Designer IP and Usage Rights
All creative concepts, draft materials, and design files remain the intellectual property of Infinity Media Design until full payment has been received. Upon full payment, the Client is granted a non-exclusive, royalty-free license to use the final deliverables as outlined in the project agreement. Infinity Media Design retains the right to showcase completed work in portfolios and marketing materials.
10.2 Third-Party Assets and Licensing
Infinity Media Design may use licensed third-party assets such as fonts, plugins, stock images, templates, or code libraries in the completion of a project. Where these assets require a valid license for continued use, the license will remain the property of Infinity Media Design unless otherwise agreed in writing.
If the Client wishes to retain access to or ownership of any licensed third-party assets following project completion, they are responsible for purchasing the appropriate licenses directly from the provider.
11. Media Delivery
Unless otherwise stated, all text should be supplied in electronic format, and images should be provided in .gif, .jpeg, .png, or .tiff format.
12. Design Credit and Marketing
A small credit link to Infinity Media Design will appear on the Client’s website, unless a fee of 10% of the project cost is paid to remove it.
We reserve the right to showcase completed work in our portfolio.
13. Third-Party Servers
Infinity Media Design designs websites to function on our servers. We cannot guarantee compatibility with third-party servers but can assist with configuration for an additional fee.
14. Hosting and Monthly Service
Infinity Media Design is dedicated to delivering reliable hosting and monthly services. The following terms outline our invoicing, payment requirements, service standards, security protocols, and support provisions to ensure a seamless client experience.
Our hosting services include 30 minutes of monthly support time to assist with minor hosting-related assistance or troubleshooting. This support does not extend to website updates, content changes, or ongoing maintenance, which are offered as separate services.
At our discretion, we may occasionally use this time to carry out small content updates or simple adjustments. However, ongoing content edits, layout changes, feature additions, or development work are not included and may require a dedicated service plan or additional fees.
For details on support processes, response times, priority handling, and communication requirements, please refer to Clause 32 (Support & SLA’s).
Clients who have been granted platform access are expected to manage routine content changes, notifications, and settings updates using the tools provided. For clients on fully managed plans or without backend access, Infinity Media Design will carry out necessary updates where appropriate, within the limits of the support time.
Where support time is regularly exceeded or used for tasks outside its intended scope, we may recommend upgrading to a more appropriate service package or introduce a pay-as-you-go support arrangement to maintain continuity.
Infinity Media Design uses trusted third-party providers to deliver hosting services. While we aim to ensure reliable performance and uptime, we do not guarantee uninterrupted service and accept no liability for downtime, service interruptions, or issues beyond our direct control.
14.1 Monthly Service Billing and Payment
Invoices for hosting, monthly services, and domain renewals (applicable
exclusively to websites hosted and managed by Infinity Media Design) are
issued on the 20th of each month, with payment due by the last day of that month.
Services are invoiced in arrears for that service month, and prompt payment is required by the due date.
14.2 Late Payment Process
All payments must be received by the last day of the invoiced month. Where payment is not received within 7 days of the invoice due date, Infinity Media Design reserves the right to apply a flat late payment administration fee of £25, in accordance with Section 3 (Invoicing and Payment).
Where payment remains outstanding for more than 14 days, services may be suspended until the account is brought up to date.
Accounts that remain unpaid for 30 days or more past the invoice due date may be subject to full service termination. Infinity Media Design reserves the right to recover any outstanding balances.
14.3 Account Security and Migration
The Client is responsible for maintaining the confidentiality of all login credentials. Infinity Media Design does not retain passwords but securely generates them using tools such as 1Password.
Should a Client wish to migrate to a third-party server, Infinity Media Design will fully cooperate, provided all outstanding invoices are settled. A transfer fee may apply for such migrations.
14.4 Email Support
Infinity Media Design will troubleshoot email issues reported by the Client at no charge if they result from an error on our part. Issues outside our responsibility, including those originating from external providers or systems, will incur a standard support fee.
14.5 Payment Reactivation Policy
If a service has been suspended due to non-payment, reactivation will only occur once the full outstanding balance has been cleared. Clients must notify Infinity Media Design once payment has been made to request reactivation.
Clients who repeatedly fail to pay on time may be required to set up Direct Debit as a mandatory payment method to continue receiving services. Infinity Media Design also reserves the right to terminate services permanently for clients with a pattern of late payments and may refuse reactivation at its discretion.
14.6 Website Framework Responsibility
Where a Client’s website is built using Infinity Media Design’s current Website Framework, a recurring Website Framework fee may apply.
This fee covers responsibility for the stability and compatibility of the Website Framework as the underlying platform evolves.
The Website Framework fee does not include content updates, design changes, feature additions, SEO services, third-party plugin licences, premium tools, or ad-hoc support requests, all of which are charged separately unless otherwise agreed in writing.
Framework Responsibility does not extend to server performance, uptime, or infrastructure-related matters, which fall solely under Hosting.
15. SEO
Infinity Media Design utilises industry-standard SEO practices but does not guarantee specific search engine rankings or consistent ranking positions due to frequent algorithm updates and market competition.
16. Post-Live Alterations
Any alterations requested after the website goes live will be quoted separately. Infinity Media Design is not responsible for changes made by the Client or third parties.
16.1 Administrator Access and Client Responsibility
Where the Client is provided full administrator access to their website, Infinity Media Design accepts no responsibility or liability for any errors, malfunctions, design issues, or technical problems resulting from changes made by the Client or any third party.
Any support or repair work required to correct such issues will be considered out-of-scope and will be charged at our standard hourly rate.
Infinity Media Design reserves the right to decline support where client or third-party changes have compromised the integrity, security, or structure of the project. A full audit may be required before support can be provided, billed separately.
16.2 Post-Handover Responsibility
For clients who choose to self-manage their website or system, project handover is considered complete once the final invoice has been paid, administrator access has been granted, and any final files or deliverables have been shared.
Once a project is handed over, Infinity Media Design accepts no further responsibility for the management, security, or performance of the project unless a support or maintenance agreement is in place.
Any future requests — including updates, edits, fixes, or maintenance — will be quoted and billed separately. Clients are encouraged to back up their projects regularly and manage any updates responsibly.
16.3 Emergency & Out-of-Scope Fixes
Requests to fix issues caused by third-party interference, plugin conflicts, or client-side changes will be treated as out-of-scope and billed at a higher emergency support rate.
Infinity Media Design reserves the right to prioritise emergency work based on capacity and is not obligated to respond to urgent issues for clients without an active support agreement.
Issues requiring extended investigation, recovery, redevelopment, or remediation beyond routine framework responsibility will always be treated as out-of-scope and billed separately.
16.4 Right to Refuse or Investigate Changes
Infinity Media Design reserves the right to refuse or limit support where Client or third-party actions have significantly modified the original setup.
Investigation of such changes may be quoted separately before any resolution is attempted. No guarantees are made for restoring functionality in cases where the original build has been altered without prior consultation.
16.5 Client Training and Platform Responsibility
Infinity Media Design does not provide client training, walkthroughs, or tutorials as part of standard services. If training is required, it must be agreed in advance and may be subject to additional charges.
Clients who are provided administrator access do so with the understanding that they are sufficiently familiar with the platform and accept full responsibility for managing their system. It is the Client’s responsibility to seek further training or assistance where required, either through Infinity Media Design (at an agreed rate) or through independent resources.
17. Domain Names
Where domain names are registered by Infinity Media Design on behalf of the client, the domain remains the property of the client. Infinity Media Design will act as the administrative contact and retain control during the term of service. Upon termination or request (provided all outstanding balances are cleared), the domain’s registrant and contact details will be updated or transferred to the client.
If we purchase domain names on behalf of the client, renewal remains the client’s responsibility. We are not liable for losses caused by missed payments.
18. Third-Party Products and Services
Infinity Media Design may integrate or provide third-party products and services, including but not limited to software, plugins, extensions, fonts, stock assets, templates, hosting, or server configurations, as part of a project.
• Such products and services are subject to the third-party provider’s own licensing terms and conditions.
• Infinity Media Design makes no warranties as to the ongoing performance, compatibility, availability, security, or future updates of any third-party products or services.
• Any faults, defects, outages, licence issues, or service interruptions arising from third-party products or services are the sole responsibility of the provider, and Infinity Media Design cannot be held liable for any resulting loss of functionality, downtime, or financial impact.
• Infinity Media Design does not continuously monitor client websites for third-party plugin, theme, or update failures, unless a separate monitoring or maintenance agreement is in place.
• Infinity Media Design will liaise with the relevant provider where appropriate to seek resolution, but ultimate responsibility remains with the third-party provider.
• If the Client wishes to retain access to or ownership of any third-party product or licence following project completion, they are responsible for purchasing the necessary licences directly from the provider.
• No ongoing service fee includes the cost of third-party plugin licences or premium tools unless explicitly stated in writing.
19. General
These terms and conditions form the entire and exclusive agreement between Infinity Media Design and the Client, superseding any prior agreements, representations, or understandings, whether written or oral. Any amendments or modifications to this agreement shall only be effective if made in writing and signed by authorised representatives of both parties. No waiver of any provision or right under these terms shall be valid unless expressly stated in writing.
Both parties acknowledge that these terms and conditions are fair, reasonable, and reflective of their mutual intentions.
Infinity Media Design reserves the right to use a range of professional tools, software, systems, and workflow platforms to support the delivery of client work. This may include automation services, enhancement tools, licensed assets, or other systems designed to uphold quality, efficiency, and consistency across all projects.
20. Liability
Infinity Media Design accepts no liability for any loss of data, delays, or inaccuracies unless resulting directly from gross negligence on our part. Our liability for all claims, losses, or damages shall be limited to the fees paid by the Client for the services in question.
In no event shall Infinity Media Design be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising out of or related to the services provided, even if advised of the possibility of such damages.
21. Severability
If any part of this agreement is deemed invalid, the remaining provisions shall remain enforceable.
22. Governing Law
These terms and conditions, and any disputes or claims arising out of or related to them, shall be governed by and interpreted in accordance with the laws of England and Wales. Both parties agree to the exclusive jurisdiction of the courts of England and Wales.
23. Client Expectations
We strive for client satisfaction and commit to professional conduct, clear communication, and timely responses.
24. Client Conduct
To ensure a smooth, collaborative working relationship and successful project delivery, all Clients are expected to:
• Maintain respectful, professional communication at all times.
• Provide required content, feedback, and approvals within agreed timeframes.
• Use designated communication channels (email or approved project platforms) for all correspondence.
• Honour the agreed scope of work and avoid requesting additional tasks or revisions outside of the contracted agreement unless previously discussed and approved.
• Inform us in advance of any delays in providing content, approvals, or payments.
To protect workflow, service quality, and wellbeing, Clients are kindly asked to avoid:
• Repetitive or excessive messaging that disrupts project flow.
• Language or tone that may be perceived as hostile, demanding, or dismissive.
• Unauthorised changes, additions, or expectations that fall outside the agreed scope of service.
Infinity Media Design reserves the right to pause or terminate services without refund if these expectations are breached.We also reserve the right to decline future work if conduct repeatedly compromises the working relationship.
24.1 Non-Disparagement
The Client agrees not to make, publish, or communicate any statement — whether written, verbal, online, or otherwise — that could reasonably be seen as damaging to the reputation or goodwill of Infinity Media Design, its services, or its representatives, regardless of whether the statement is believed to be true.
Any breach of this clause may result in immediate termination of services and may be pursued through legal channels where appropriate.
25. Website Security and Hacking
Infinity Media Design employs industry-standard measures to enhance the security of Client websites; however, we cannot guarantee immunity from hacking, viruses, or data breaches. Accordingly, we accept no liability for damages arising from these events.
In the event of a security breach, the Client is responsible for resolving the issue. Infinity Media Design will offer support and guidance where possible, but the ongoing application of security updates and patches remains the Client’s responsibility.
Infinity Media Design reserves the right to suspend or remove any compromised website hosted on our servers to protect our infrastructure and the security of other clients’ websites.
26. Termination for Breach
Infinity Media Design reserves the right to terminate services immediately, without notice, if the Client breaches these terms and conditions. In such cases, no refunds will be provided, and Infinity Media Design retains the right to seek legal recourse for any damages incurred. Termination for breach may also result in the removal of all hosted content or services associated with the project.
27. Consequential Damages
Infinity Media Design accepts no liability for consequential losses.
28. Loss of Business
We are not responsible for any business losses resulting from our services.
29. Non-disclosure
Each party agrees not to disclose any confidential information, including but not limited to business processes, pricing structures, technical information, or proprietary methods, without prior written consent. This applies both during and after the contract period.
30. Force Majeure
Infinity Media Design shall not be held liable for any failure or delay in fulfilling its obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, equipment failures, internet outages, acts of government, pandemics, or other unforeseen events. In such cases, affected obligations will be suspended for the duration of the disruption.
31. Data Protection & GDPR
Infinity Media Design is committed to complying with applicable data protection laws, including the UK GDPR. We will only process Client data to deliver agreed services and never share it with third parties without consent, except where required by law. Please refer to our Privacy Policy for full details.
We may also send marketing emails to individuals who have opted in to receive them. All such communications include a clear unsubscribe option. We do not send marketing emails without consent.
Infinity Media Design is registered with the Information Commissioner’s Office (ICO) under the UK Data Protection Act and complies with all applicable data protection laws and regulations.
32. Support & SLA's
Infinity Media Design provides support for issues directly related to the services we supply. This may include technical assistance, troubleshooting, or advice on the effective use of our services, subject to the limits and scope outlined in Clause 14 (Hosting Support) and your service agreement. Requests that fall outside the agreed scope — including ongoing content changes, new functionality, or third-party platform issues — will be quoted separately as billable work.
Support Response Times
We aim to respond to general support queries within 1–2 working days, subject to workload and availability. During peak periods, this may extend to a maximum of 5 working days.
Urgent service issues (e.g. hosting outages) are prioritised and addressed as quickly as possible, subject to availability.
Different response times may apply if you are subscribed to an Infinity Media Design Care Plan or other enhanced service package, in which case the agreed priority timescales in your plan will take precedence.
Support Priority
• Urgent: Service outages, security issues, or critical faults affecting availability.
• Standard: All other requests, handled in the order received.
Approved Communication Channels
SLA response times apply only to requests submitted via approved channels — namely email, designated project management tools, or other official channels expressly approved and provided by Infinity Media Design (see Clause 6.3). Requests made via unapproved channels will not be subject to SLA timelines.
Non-billable vs Billable Support
Any non-billable support is provided entirely at our discretion. Time spent resolving issues caused by the Client’s error, omission, or failure to follow agreed processes — including use of unapproved communication channels will be charged at our standard rate. Infinity Media Design reserves the right to refuse non-billable support in such cases.
32.1 Time Logging
Infinity Media Design logs all time spent on client matters, including but not limited to support tasks, project work, troubleshooting, research, and general communication (such as emails and calls). Logged time is categorised for transparency and may include both billable and non-billable entries. Whether time is billable depends on the client’s service plan, agreed allocations, or at the discretion of Infinity Media Design where activities fall outside of scope. Non-billable entries are recorded for tracking and transparency but will not appear on invoices.
33. Email & Technology Responsibility
Infinity Media Design will not be held responsible for missed communications resulting from spam filters, full inboxes, or unmonitored email accounts. It is the Client’s responsibility to ensure they can receive and access email updates from us.
34. Updates to Our Terms and Conditions
By engaging with Infinity Media Design, whether through verbal agreement, email, payment, or any other form of acceptance, the Client agrees to abide by these terms and conditions. This acceptance extends to all current and future updates, which are accessible on our website at any time and may be made without prior notice.
As part of our ongoing commitment to improving service efficiency and maintaining fair policies, updates have been made to our payment terms, including service suspension for late payments. These changes take immediate effect and apply to all current and future invoices. To remain informed, we provide links to our terms within order confirmations, invoices, and on our website. The Client is responsible for reviewing these terms regularly to stay up to date with any changes.
We value transparency and are always available to discuss any aspects of these terms and conditions. Should you have any questions or require further clarification, please feel free to contact us.
35. Cancellation of Services
To cancel any of our services, we require one calendar month’s written notice via email or letter. The notice period begins on the first day of the month following receipt of your cancellation request. Services will continue through the end of that month, and billing will reflect the full period.
Cancellations made mid-month will take effect at the end of the following month, with billing continuing accordingly. All outstanding payments must be settled before final deliverables or access to project materials are released.

36. Data Retention (Post-Termination)
Following termination of services, Infinity Media Design may retain project-related files or data for a period of up to 30 days. After this time, all files may be permanently deleted unless otherwise agreed in writing.
37. Feedback and Reviews
Clients are encouraged to provide honest feedback about their experience with Infinity Media Design. If a concern arises, we request that Clients contact us directly in writing to allow the opportunity for resolution before publishing public reviews or complaints.
We are committed to handling feedback professionally and constructively. By engaging with our services, the Client agrees to make reasonable efforts to resolve issues privately before posting any negative or defamatory content publicly.
38. Legal Policy Compliance
Infinity Media Design may assist in the implementation or setup of standard legal policy documents, including but not limited to privacy policies, cookie notices, website terms and conditions, disclaimers, or return and refund policies. These documents may be generated using third-party tools or templates and are provided as general guides for convenience only.
Such assistance does not constitute legal advice, nor does it guarantee compliance with applicable laws or regulations. The Client remains solely responsible for reviewing all such policies and for ensuring their accuracy, completeness, and legal validity in accordance with their business type, jurisdiction, and regulatory obligations.
It is the Client’s duty to seek independent legal advice where necessary and to ensure ongoing compliance with evolving legislation, including (but not limited to) the UK GDPR, Data Protection Act 2018, PECR, and any sector-specific regulations.
Infinity Media Design accepts no liability or responsibility for any losses, claims, or penalties arising from the use, omission, or enforcement of such documents, whether or not assistance was provided in their setup.
This disclaimer applies regardless of whether Infinity Media Design customises, edits, hosts, or embeds such policies on the Client’s behalf.
